Wrongful Death

Under Illinois Law, the "wrongful death act" 740 ILCS 180/1 et seq establishes a separate cause of action for the surviving spouse or "next of kin" of a person who dies as a result of the "wrongful act, neglect or default" of another.

Under Illinois Law, the beneficiaries are entitled to recover damages for the loss they have sustained by reason of the bodily injury victim's death.

Recovery under Illinois Law is for the exclusive benefit of the decedent's surviving spouse and next of kin. The term "next of kin" is defined as blood relatives in existence at the time of decedent's death, who would take personal property in case decedent died intestate (without a will).

Included among those who might be potential wrongful death claims are: Adult child, remarried surviving spouse, adopted child, illegitimate children, siblings.
