Marital Property Division

The Courts strive to make an equitable division of marital property. Under Illinois Law, marital property generally includes all assets and debts accumulated during the course of the marriage. Non-marital property has been defined under Illinois Law as property received as a gift or property which has been inherited by one of the parties. Under certain circumstances, non-marital property can be transmuted or comingled with marital property and lose its status as a non-marital asset. Marital property can include:

  • Corporate interests
  • Real estate
  • Savings, checking and money market accounts
  • Credit card debt
  • Stock options and deferred compensation
  • Retirement benefits that were earned during marriage

Under Illinois Law, the Courts will use the standard of "equitable property division." The term "equitable" does not necessarily mean a 50/50 division.
