Joint Parenting

In a divorce action, the parties may agree on joint custody of the minor child/children.

When the parties agree to a joint custodial arrangement, one of the parties is usually named as the primary "residential custodial parent".

It is important that your attorney draft the appropriate joint parenting agreement whereby the parties acknowledge their rights and liabilities as they relate to parenting.

The Court will allow joint parenting when each parent possesses the ability to cooperate effectively and consistently toward the best interest of the child/children.

A joint parenting agreement is designed to secure the maximum involvement and cooperation of both parents regarding the physical, mental, moral and emotional well-being of the parties' minor children.

Under joint parenting agreements, both parties have the right to make joint decisions concerning the children's best interest.

As joint parents, the parents will actively participate in raising and guiding the children and to that end share information and will decide important matters pertaining the child's medical, dental, and psychological needs, as well as the children's upbringing, religious training, education, and progress in school.

Additionally, a joint parenting agreement will also provide a visitation schedule in order to maintain continuing, frequent contact with both parents.
