Child Support, Modifications & College Expenses
1. Child Support - Illinois Child Support Guidelines
There are many issues that are subject to negotiation in a contested divorce. However, the amount of child support you pay,
are entitled to receive, and are determined by a formula which considers the net income and the number of children
supported as reflected in the following table:
NUMBER OF CHILDREN ...... PERCENTAGE OF PAY OR NET INCOME
FOR SUPPORT
One ...... ....................................................20%
Two ...... ....................................................28%
Three .... ....................................................32%
Four ..........................................................40%
Five ...........................................................45%
Six or more ................................................50%
Under Illinois Law, the Court can deviate from these guidelines in certain circumstances. Since 1982 I have had extensive appropriate amounts of child support.
2. Modifications of Child Support in Illinois
Once determined, child support may be modified if there is a substantial change in circumstances. If there is a substantial
reduction in income, the Court will take that into consideration in reducing child support. Likewise, if the payer receives a
promotion or raise, child support may be recalculated so the children can receive the benefit of the parent's payer's success.
3. College Expenses
Under the Illinois Marriage and Dissolution of Marriage Act, a parent has standing to file a petition to requesting another
parent to contribute to the post high school college or vocational school expenses. As a general rule, the student must attend
the college or tech school right after graduating from high school. The Courts will review the household incomes and
expenses of both parents.
To receive support, the child must be enrolled as a full-time student in good standing and make good progress toward his or
her degree. Often the Courts will make the child assume some financial responsibility such as applying for financial aid or
taking summer or part-time employment.
