Maintenance (formerly known as "alimony")
The issue of maintenance is a highly litigated issue in a divorce case.
Most parties to a divorce action understand that their will be divided in an equitable manner.
Furthermore, the non custodial parent generally understands that he or she will pay child support pursuant to statutory guidelines. However, many divorce clients are unwilling or unable to voluntarily pay their spouse maintenance.
Generally these issues can be highly litigated.
There are two primary types of spousal maintenance in Illinois:
- Rehabilitative maintenance or payments defined over a defined period of time
- Permanent maintenance which are payments provided to a spouse without a stated end date
The purpose of maintenance is to allow the person receiving maintenance to be self-supporting.
Rehabilitative maintenance is often "reviewable" factors that contribute to the determination of maintenance consist of the length of marriage, the disparity of income and assets of the parties, as well as the age and health of the parties.
It should be noted that maintenance, formerly known as alimony, is taxable to the person receiving it and is a tax deduction to the person paying it.
